ICTR: judges deny Bagaragaza's transfer

On May 19, the International Criminal Tribunal for Rwanda (ICTR) denied a motion filed by the prosecutor in February [IJT-41] requesting that Michel Bagaragaza, former head of Rwanda's tea industry, be transferred to Norway for trial. "The Kingdom of Norway does not have jurisdiction to try the crimes alleged in the indictment of Bagaragaza," ruled the judges. Accused of genocide by the ICTR, Bagaragaza would have been tried in Norway for an accessory to homicide, since the crime of genocide did not exist in Norwegian law in 1994, the date of crimes alleged in the indictment. This was the first time that the ICTR prosecutor sought such a transfer.
