La cámara de recusación del tribunal de Ámsterdam se tomará hasta el martes a las dos de la tarde para analizar la recusación presentada por el abogado Bram Moszkowicz. A poco menos de dos horas desde que se iniciara el sonado proceso contra el líder del PVV Geert Wilders, el abogado impugnó a los jueces a cargo del proceso en Ámsterdam. Según Moszkowicz y Wilders, el tribunal ha despertado la sospecha de parcialidad.
El político dio a conocer al comienzo de la sesión que se acogía a su derecho a guardar silencio. “Yo considero que he dicho todo lo que había que decir.” Además manifestó su intención de no responder a ninguna pregunta del tribunal o del Ministerio Público.“Vergonzoso”
El presidente del tribunal de Ámsterdam, Jan Moors, señaló a continuación que los jueces leen los diarios y miran televisión y que “da la impresión, tal como se ha constatado frecuentemente en los medios, que Wilders quiere evitar la discusión.” A lo que Moszkowicz contestó que eso no varía en absoluto el hecho que Wilders pueda acogerse a su derecho a guardar silencio. Es un derecho elemental, según el letrado.
Un acusado en un proceso en Holanda tiene el derecho a no prestar declaración debido a que nadie está obligado a colaborar en su propio enjuiciamiento. “Imprudente, inconcebible y vergonzoso”, calificó Geert Wilders los comentarios del presidente del tribunal Moors.
Odio y discriminación
Según el abogado Moszkowicz su cliente está enfrentando una disposición legal “que más parece una condena.” Geert Wilders está siendo juzgado según una decisión del tribunal de Ámsterdam. El Mnisterio Público no quería realmente procesar a Wilders. Quienes habían presentado la querella en su contra apelaron ante el tribunal, con éxito.
El Ministerio Público acusa a Wilders de haber ofendido a los musulmanes a través de haber comparado el Corán con “Mi Lucha” de Hitler. Igualmente Hitler habría hecho declaraciones que llamaban al odio y la discriminación en periódicos como De Volkskrant y De Pers.
Fitna
La Corte destinó un total de cinco días para el caso. Una parte importante del tiempo estaba destinada a tomar declaraciones al acusado. Debido a que Geert Wilders no responderá preguntas, el proceso seguramente se acortará considerablemente.
Durante el juicio se tratará también el video anti-Islam Fitna. Éste fue publicado en internet en marzo de 2008. El Ministerio Público quiere utilizar la película en la acusación contra Wilders.
Mucha policía
El sonado proceso está rodeado de enormes medidas de seguridad. A la entrada del tribunal hay una gran cantidad de policía. El público y la prensa deben ingresar por una entrada aparte. Entre los periodistas hay también muchos reporteros extranjeros.
Recusación
El juicio contra el líder del PVV ha sido suspendido a la espera de la decisión sobre la recusación presentada por el abogado Moszkowicz. Los jueces recusados deberán también ser escuchados y pueden ellos mismos exigir serlo. El fallo de la cámara de recusación es inapelable.
En caso que se acepte la apelación del abogado de la defensa, la Corte deberá nombrar otro tribunal para que continúe el proceso.
