No decision has yet been taken on whether Saif al-Islam Gaddafi will be tried in The Hague or in Libya.
A spokesperson for the International Criminal Court made the statement after Libyan Justice Minister Ali Khalifa Ashur announced that the ICC had agreed to try the son of former dictator Muammar Gaddafi in Libya.
The ICC says it has not even received a formal request for a trial in Libya. On Monday, the ICC received a number of confidential replies to questions the Court had asked the Libyan authorities.
Saif al-Islam Gaddafi was captured while trying to flee Libya after the death of his father. He is wanted by the ICC for crimes committed during the attempts to suppress the popular uprising. Saif al-Islam played a prominent role in his father’s regime.
