Chief Prosecutor Luís Moreno Ocampo of the International Criminal Court in The Hague wants to start an investigation in December into the violence in Kenya after the 2007 elections.
Mr Moreno Ocampo, who is visiting Kenya, believes human rights violations were committed.
President Mwai Kibaki and Prime Minister Raila Odinga have promised their cooperation, although there are huge divisions within the government over how to deal with suspects. Many government ministers were actually involved in the unrest.
The violence erupted when Mwai Kibaki was declared the winner of the 2007 presidential election. Raila Odinga disputed the result. Eventually they agreed to form a coalition.
An estimated 1400 people were killed in the last days of 2007 and the first weeks of 2008. Hundreds of thousands of people were driven from their homes in the east African country, which up to then had been stable.
The ICC was set up in 2002 to try individuals accused of genocide, war crimes and other human rights violations.
