Transavia pilot Julio Poch, who is under arrest in Spain, will not be transferred to the Netherlands.
A judge in The Hague ruled that the Dutch-Argentinian pilot who was arrested in Spain at Argentina's request at the end of September would not be allowed to return.
The Argentinians accuses Mr Poch of carrying out death flights during the military dictatorship in the Latin American country in the 1970s. On the flights, political opponents of the Videla regime were thrown out of planes into the sea alive.
Mr Poch had requested a transfer, so that he could be tried here, but the Dutch state thinks he should face trial in Argentina.
A Spanish court will decide whether to extradite the pilot to Argentina next month.
