Church schools can fire gay teachers

Published on : 29 September 2009 - 4:00pm | By RNW News Desk
More about:

Gay teachers can be dismissed by religious schools if it can be shown that their homosexuality clashes with the ethos of the institution. The Dutch Interior Minister, Guusje Ter Horst, made this statement in a letter to parliament attempting to clear up uncertainty on the highly controversial issue.

Up to now religious school boards faced legal proceedings if they expelled homosexual teachers.

The law was unclear as two constitutional rights clashed: freedom of education and freedom of sexual orientation.

In her letter, Minister Ter Horst says schools are entitled to demand that their staff adhere to the school's principles.

In the case of strict Christian schools, this means they are entitled to reject applicants or sack teachers if their sexual orientation conflicts with the school's Christian values.

Nevertheless the minister stresses that in general homosexuals cannot be sacked or refused employment purely on the basis of their sexual orientation.

This gets around the anti-discrimination Universal Equal Treatment Act (AWGB), which states that religious schools are not allowed to sack an employee because of the "single fact" of a homosexual nature or a homosexual relationship but can make a distinction on the grounds of "additional circumstances".

Last May, a Christian primary school in the Dutch town of Emst suspended a gay teacher on the grounds that his sexual orientation conflicted with the mission of the school. Religious schools in the Netherlands are state-funded in the same way as non-religious schools, based on the principle of freedom of education.

In June, the Council of State, the Netherlands highest advisory body, ruled that although schools are not allowed to discriminate, they can make specific demands of their staff.

The minister's letter is at odds with the Education Minister, Ronald Plasterk's view that schools have no right to dismiss teachers for being openly gay.

In her letter, Ms Ter Horst admits that existing laws are confusing, although there are no plans to change legislation on this matter.

She says her letter is intended to clarify matters.

What do you think? Should religious schools be given a wider margin to dismiss teachers on the basis of the sexual orientation?

I AM BI-SEXUAL AND LOVE MEN, SO WHAT??

Anonymous 26 September 2011 - 11:24pm

Christ taught you have turned it around to say what you want it to say so you can move upon whatever your agenda is. Love is a taught subject of Jesus and he did love us all, but to come to him and be with him in the after life you have to listen to what the words say. Homosexuality is not on the list. Read Romans 1 to get more educated. Like you, homosexuals have turned the messages of Christ to read what they want so to change the means. I am sorry you are so wrong. mike

This may be an old thread but when I see the pure evil that is written here I can't help but feel revulsion.

I am amazed at how certain religious believers are capable of living in society without slitting the throats of their gay neighbours given the depth of their hatred and their demands to be allowed to discriminate in truly repugnant ways. These "ordinary" folks are the ones that give all believers a bad name.

It IS a sin and freedom of speech says that we can say it, as long as dont provoke action. Period.
But the thing is that gays are on the path of directing the sexuality of the youth.
Then they can control the front.

tim avants 24 May 2010 - 3:20am / USA

The goal of the homosexual activists is to indoctrinate the youth into the lifestyle. Therefore, they grow up believing this is "normal" and thereby participate from the beginning. I applaud the recognition by the state to allow religious schools to maintain certain expectations in the school's perameters. Otherwise, there is no freedom that is guaranteed by law. Too much freedom results in restrictions. 1939 Germany is a classic example.

They shouldn't be hired in the 1st place! Religious schools have an obligation to the parents who send their children to those schools to hold fast to the ethos of the school. A teacher will impart their values to their students. Children look up to their teachers as examples and role models. An openly gay teacher will often adopt the common openly gay flamboyancy and charisma - and this in itself sends a powerful message to the students. So no. Please. Respect the rights of the parents to decide on the type of role-models that they wish for their children. The right to NOT ACCEPT homosexuality as a valid alternative to heterosexuality needs to be respected and upheld ESPECIALLY in schools and institutions.

Richard Kirker 10 November 2009 - 6:42pm
There is absolutely no valid reason to discriminate against gay people in any situation. All the reasons used to try and justify discrimination amount to just one ugly phenomena - homophobia. Shame on the Dutch government and all faith bodies hiding behind the sham twin edifice of tradition and fundamentalism. Faith schools like all schools can only offer a full, prejudice-free education if they employ openly gay people. Any education system which fails to do this is failing its children - gay and straight - to prepare for the real world.

Nox where will the children going to gay schools have come from? Heterosexual people right? Do gays have the natural ability to have children? Apart from adoption or using test tube techniques on lesbian couples there is no conceivable way for gays to bring forth children in this world. Is it any wonder then that they want to corrupt the rest of society with their lifestyle? Why can't gay people be satisfied with the public arena rights they have? Why do they even want to come and force themselves in our churches and schools? Has our democracy become a battering ram of forcing homosexuality on us? Soon they will demand to enter our living rooms by force and ask us to swear allegiance to the worship of homosexuality. Leave private schools, households and other private fora out of your grand plans of proselytizing homosexuality we have had enough already. Why don't heterosexuals hold gay pride events? Why all this efforts to continually push homosexuality? Is it a superior and unique sexuality to the rest of us?
Anonymous 8 October 2009 - 6:09pm
Yes. There is a difference between "discrimination" and having "discriminating taste". All of us choose who we will hang out with or not and it can either be discrimination or a choice of what friends share our common values and interests. I admit it is a fine line but in our free society we must give individuals the right to associate with whom they wish and to the same extent whom they will employ. But we must also ensure that people do not do it solely on discrimination grounds. We can't "throw the baby out with the bath water" by denying inidividuals and institutions the right to having "discriminating tastes".
Nox 7 October 2009 - 3:46pm
If it is allowed for schools to discriminate based on belief then Muslim schools can fire any non-Muslim teacher and gay schools can be created where any non gay teachers are fired. Allowing beliefs to be treated as something important instead of just some ideas that people have will destroy all the tolerance that Dutch society has worked hard to develop.
Hiram 7 October 2009 - 5:20pm
Nox, you are right in the first sentence but off a litle bit on the second sentence. If Muslims want to start a private, Muslim school, they shouldn't have to accept anybody who does not believe and support Islamic beliefs. The same goes for any private schools. If someone or a group of gays want to have a private, school which teaches homosexuality as proper and right, why should they have to hire a Muslim or Christian teacher who is going to teach the opposite. They wouldn't hire anyone whom they tag as homophobic. It would go against their belief system, right? Do you think, a private, Gay school would hire any teacher that believes and teaches that homosexuality is wrong? I think not and that is why your second sentence is a bit of a spot off. Muslim and Christian private, schools have a belief system too and they should not have to hire anyone who goes against their belief system.
François 5 October 2009 - 3:11pm
Thank you Hiram for your reasonable defence of Christianity and the right of the religious to practice their faith without interferance from homosexual preachers. They are very intolerant of our religion and even wish our demise but they dont believe in our right to differ with them. They want to even corrupt our children with their own ideas of what constitutes a normal lifestyle. They naturally cannot bring children into this world without employing artificial means. Yet when you tell them homosexuality is unnatural they call you ignorant. Now they want to adopt offspring of heterosexuals and even be teachers of our children in our christian schools after they took over public schools. They even want to interpret for us our religion. For anyone who doubts God's displeasure with homosexuality just read about Sodom and Gomorrah. Also the intolerance of homosexuality did not begin now. If you read the story of Lot you will see the homosexuals forcibly wanted to sleep with the Angels against their will. The Angels had to employ supernatural powers even after Lot had offered his own daughters to protect his visitors. Homosexuals are the most intolerant. Look also what happened when proposition 8 was defeated in California they accused blacks of being ungrateful and the other people as being ignorant. How informed they must be. Christianity is not tolerant of evil at all.

It is very disturbing that RNW lets people like Hiram post. There are numerous KKK websites for people like Hiram to post hatred
Hiram 3 October 2009 - 10:40pm
Hello Jan, I see people, by reading your lack of tolerance of non-gays (for people have religious faith) have no right to speak out against a life style that has been considered a sin and negative lifestyle. Why does a gay person have a right to say homosexuality is proper and correct but when a non-gay speaks out against such a lifestyle, he or she preaches hate? where did I preach any hate in my opinions? You didn't see any because I didn't preach it. When accusing a person preaching hate, you might point out the hate speech. It appears, when someone says something you disagree with, you yell "hate" to support your belief. It doesn't work. The lifestyle in which you think speak "hate" about is a lifestyle that has caused adverse health problems around the world and many (millions) have suffered from it. As to the spirtitual aspect, my words were for anyone who professes Christianity and living such a lifestyle at the same time. If you are not a Christian so be it but Christians have a moral obligation to use there "freedom of speech" to help a fellow Christian from stumbling a sin that is considered detrimental to their spiritual well being. Therefore anyone who is a gay and not religious shouldn't be bothered. Be nice, okay, people (this includes gays) can do whatever they want. No one said they couldn't. P.S. You opined "It is very disturbing that RNW lets people like Hiram post." You should have said Hiram and Jan, right?
Jan 3 October 2009 - 3:02pm
I don't have a problem with firing homosexuals, as long as I can fire christians for being christian.
waiting for you to evolve, please! 2 October 2009 - 9:26pm
If what Hiram, Francois & Anonymous espouse is "Christ-like" behavior, then I'm so glad that Christianity is a dying religion. Now, if we could just get Islam & Orthodox Judaism into that same sinking ship a little bit faster, the world would be a much better place. Nothing has done more damage to the world and its people than these 3 "religions". Stop denying people their civil and human rights in the name of God, Allah & Yahweh! If people weren't meant to be gay [by God, Allah & Yahweh] there wouldn't be any gay people. Face the facts - please shut up, sit down and leave us alone! Haven't you killed & hurt enough!?!
Net Angel 26 March 2010 - 2:48pm

You actually ARE being left alone. As long as you don't trample ground that belongs to people from other moral convictions. People can choose what they wish to believe. Maybe a little more respect and 'live and let live' for people who don't agree that homosexuality is natural / healthy / Godly, wouldn't go astray?

Hiram 2 October 2009 - 11:59pm
waiting for you to evolve, OPINED " Nothing has done more damage to the world and its people than these 3 "religions". Stop denying people their civil and human rights in the name of God, Allah & Yahweh!" You might be right but do you realize how much damage, i.e, deaths to innocent people homosexual acts have caused via HIV? One doesn't have to believe in G-d to understand the vast damages caused by homsexual relationships around the world. In parts of Africa, where homsexual acts are on the rise, HIV is destroying millions of lives. You also OPINED "If people weren't meant to be gay [by God, Allah & Yahweh] there wouldn't be any gay people." If one is gay he is gay by choice. There isn't any DNA that makes a man or woman become gay. It is all about choice. Now, the homosexual community believes they have a right to be homosexuals and you know, they do have a choice and a right; but, the homosexual community does not like it when anyone speaks out against them. Why can't non-homosexuals have a right to speak out against homosexuality? As to your very last sentence, you need to think about who is hurting whom? Get the facts about HIV and see how it is transmitted and you will see the millions who have died from HIV but I doubt it very much you will see or admit it. Why? Because homosexuality blinds the Truth. It is like any addiction, it distorts or twists the Truth. P.S. Those other comments were made to anyone (gays) who calls himself/herself a Christian? Why, would you want to hinder a gay person from changing to new life style as a Christian? They also have choices but they can't be a Christian and call themselves Christians at the same time. It just doesn't work. One just can't lead a G-dly life and be a practicing adultress, glutton, or homosexual and that is a fact.
elizabeth 5 January 2010 - 1:31pm / Belgium

What a load of nonsense: you do NOT have the choice to be gay. You are born gay. There IS evidence that this is in your DNA.
And this HIV-story (as if this was God's punishment to gay people) is such nonsense as well. So all the other diseases, like cancer for instance, are a punishment to heterosexuals as well?

It would be good for everyone to realise that there are same sex short- and long-term relationships, just as there are short- and long-term relationships between heterosexuals. As if heterosexuals don't sleep around! Could we all be a bit more open-minded about things? And also honest with ourselves. If people weren't so prejudiced and narrow-minded, life on earth would be much more pleasant for everyone.

Can I just say that I am a very happily married woman (with another woman). We have two lovely kids, they go to kindergarten, and we both work. We have a house, a car etc. We have family, friends, neighbours, etc. who love us. Our life is in no way different to any heterosexual couple. I am very happy living in Belgium, I must add, where I never meet anyone saying such nonsense. Here, no one even blinks a eyelid when I say I am married to a woman. I am very open about me having a wife, and not at all embarassed or ashamed about my life. On the contrary, I feel very lucky I can be with a woman who understands me very well. We have a very strong and loving relationhip. The children get all our love and attention, and I am sure they'll be happy, open-minded people when they're grown ups, with a lot of love to give themselves.
It's ll about love, after all. Why people make such a fuss about the fact that two people love each other and want to share their lives with each other, is beyond me. God is love, and I honestly don't think at all he is remotely interested whether this love is between heterosexuals or homosexuals. As if that would preocupy him!

I also thaught at a catholic school. With the life I lead, I can't see anything which would be offensive to that religion. But Belgium is a bit of an exeption there, in that catholicism here is very liberated. So, we got married in a church and had a wonderful wedding. Our priest 'blessed' us. Family and friends are still talking about this wonderful wedding; a very happy occasion. I wish all heterosexuals and gay people in the world the same experience. And to all those 'christians' out there who think they're interpreting the Bible well by discarding gays, I can only say this: you are wrong. This is not what the Bible says, it's all about interpretation. The key message is: love. And it is not christian at all to discard anyone.

tim avants 24 May 2010 - 3:45am / USA

Elizabeth, no Christian should discard you but only the act of homosexuality. Let's see what the Bible does say about same sex relationships...
"Thou shalt not lie with mankind, as with womankind: it is abomination. Lev 18:22
But that's the Old Testament, you say, and doesnt matter!
"For this cause, God delivered them up to shameful affections. For their women have changed the natural use into that use which is against nature" (Romans 1:26).
Why? For what reason?
Well, verses 23-25 say, because "claiming to be wise, they became fools. 25 Who changed the truth of God into Wherefore, God gave them up to the desires of their heart, unto uncleanness: to dishonour their own bodies among themselves. exchanged the truth for a lie and worshipped and served the creature rather than the Creator, who is blessed for ever. Amen"
That means that we become so puffed up in thinking that we know things that we, as humans, all of humanity, are bound to be turned over to misled thinking, See, it seems right because God turns us over. People are turned over to greed, lust, drivem pre-occupation, and many other things.
But why is it at a young age? It's inborn! (you may answer)
No, demons or seducing spirits follow a family line where forefathers have sinned without repentance and attack the kids. Or, demons start somewhere that the parent has not been diligent. We must see it for what it is. In "Hostage to the Devil," a demon responded to the exorcist's questions "why possess this person?" It answered "He was chosen before birth." Readers, I urge you to get alone and pray "in the name of Jesus, Lord I am sorry for all sin and please teach me your truth." From there, you will learn, maybe fast or slow but you WILL see if you put your mind to seek God as a person thorugh His Word made flesh and come in the name of Jesus. We decry the act but stand for you and your salvation. Tim Avants

Net Angel 26 March 2010 - 3:02pm

Elizabeth. No one is being 'discarded' as you say. The question this forum raises is 'should religious schools have the right to fire openly gay teachers'. And the answer to that is quite reasonably that private schools MUST choose carefully and discriminately the role models for the children they are responsible to teach, based on the ethos of the school that was chosen by the parents for those children.

We all make our choices, and they must all be respected. But not necessarily embraced by everone, yeah?

raggenfoul0 25 May 2011 - 5:00pm

I admire the valuable information you offer in your articles. I will bookmark your blog and have my children check up here often. I am quite sure they will learn lots of new stuff here than anybody else!

Intolerance is 90% ignorance and 10% meaness. These churches suffer from an acute case of both. Christ never said a word against gays. These churches teach a message of hate and bigotry, the exact opposite of Christ's message of love and acceptance.. I don't know what religion these churches pretend to espouse, but it is not the religion of Christ.
Anonymous 1 October 2009 - 6:56pm
Larry you have need to read further than what you want the Bible of Christ to say. Not only are you guily of not reading the whole of what Christ taught you have turned it around to say what you want it to say so you can move upon whatever your agenda is. Love is a taught subject of Jesus and he did love us all, but to come to him and be with him in the after life you have to listen to what the words say. Homosexuality is not on the list.
