Lawyer to request release of Joran van der Sloot

Published on 23 May 2011 - 9:28pm
More about:

If the trial of Dutchman Joran van der Sloot in Peru has not begun within six months, his lawyer Máximo Altez will submit a request for his client to await trial outside prison according to the Dutch press agency ANP.

Joran Van der Sloot was arrested almost a year ago on suspicion of the murder of Peruvian woman Stephany Flores on 30 May 2010.

“The law says a trial should begin within 18 months,” said the lawyer. “If that doesn’t happen the accused should be released. That is not the same as an acquittal.''

Mr Altez expects the Public Prosecution Office to charge Van der Sloot within a month with either first degree murder (premeditated murder) or manslaughter.

If he is charged with manslaughter, Joran van der Sloot will plead guilty. In Peru, murder carries a 35 year maximum sentence. Manslaughter carries 20 years, but his lawyer believes with good behaviour his client could be released after just five or six years.

In case he is charged with murder, the defence is contesting police interrogations of the Dutchman. No official translator was present and Joran van der Sloot was not allowed to phone anyone which is against the rules. These objections have already been rejected, but the defence has filed an appeal. If the defence wins the appeal, it means Joran van der Sloot’s confession is no longer admissible.

Mr Altez is also involved in defending his client against accusations in the US that he tried to blackmail Natalee Holloway’s family in exchange for information on where the body was hidden. The teenager disappeared on the Caribbean island of Aruba exactly five years to the day before the murder of Stephany Flores. It's assumed she is dead but her body was never found. Joran van der Sloot is still the prime suspect although police do not have sufficient evidence to prosecute him. His lawyer claims it is the family who put his client under pressure to reveal the whereabouts of Natalee Holloway’s body and offered five million dollars for information.

Mr Altez denies rumours in the Peruvian media that his client wants to be extradited to the United States. He does not know whether or not the Dutchman will take advantage of new agreements to allow Dutch prisoners to finish their sentences in their home country.

"I hope like hell Joran gets out of all this staged bull.... and sues the hell out of Beth and anyone else involved.I pray for Joran and his family.

What is this his mommy? Staged? Please post some FACTS about how this is staged. Maybe you can post FACTS as to why he has nothing to do with the case in Aruba as well.....I won't hold my breath for a reply.

FACT - anyone with half a brain that WASN'T involved in the disappearnce of a young woman would NEVER, EVER, EVER, make up stories about the case if they ended up being a suspect.

MNIN2010 24 May 2011 - 9:46pm

Typical lawyer nonsense. A month ago, Joran was ready to plead guilty to a "crime of passion" invoking the temporary insanity defense. Joran was ready to say to the court "Your honor, I was sane. Then I went insane when she looked at my computer, which by the way had nothing on it, and so I killed her. Now I'm sane again, can I go home now?" as if that will would work. If someone goes insane and commits murder that easily, they should be locked up FOREVER. Today, however, realizing that he was caught literally red handed with no hopes of a successful insanity defense, Joran is ready to plead guilty to manslaughter. I certainly understand why. His case is hopeless and he's headed down the path of a guilty verdict for murder. For this latest manslaughter deal to work, the prosecutor would need to agree to it. Why would the prosecutor even consider it? There is AMPLE evidence to convict Joran of murder one. He cons Stephanie into going to his hotel room. He kills her with his own shirt. He robs her of all her money, her credit cards and steals her car. He fakes an alibi. He attempts to dye his hair but accidently makes it orange. He flees Peru. He lies to the police. He never ever calls 911. Not exactly the behavior of someone that accidently murders someone else and is remorseful. His blood on her. Her blood on his clothes. Videotapes, etc. Nope... the prosecutor will not accept manslaughter. Joran will be found guilty of premeditated murder and sentenced to 30 years in prison. He will not be granted extradition to the Netherlands. He will rot in a Peruvian hole just like he deserves. And when he gets out in 20 years or so, he will be flown to the US to stand trial for extortion. He will be found guilty and sentenced to another 15 years in a US prison this time. he'll serve 10 and in 2040, he'll be released to the Thailand authorities to face human trafficking charges. Party's over Joran. See Ya.

Another ridiculus comment blaming the victims of crime and those who catch criminals rather then the perps who committed them by none other than the one and only Boycoyt/RachelM/MaryS/MaryMary/MarySmith/anonymous/etc. JVDS is a two time murdering, rapist, robber, liar, extortionist, father hating, human trafficking scumbag and deserves life in a hole. This person is no better than he is. Another lowlife scumbag brainless loser who writes under multiple pen names to make us all think she is a crowd. She isn't. Just one sick individual.

"Perps", huh. Now I understand your mindset. You're a cop. - Mary S.

Hitting the 1 year anniversary and still this drags on. Closure for the Holloway/Flores families would be nice!

Anonymous 25 May 2011 - 5:43am / Canada

Hi Marie; it drags on because they have a bogus case, perhaps. Mary S.

Marie 26 May 2011 - 6:21pm / USA

Mary, where you been?

Anonymous 27 May 2011 - 6:04am / Canada

Hi, it's me, I've been here now and then as RachelM. The MaryS login no longer works. Lately it's been easier to log in as Anonymous, and then just sign my name. Where's my former Friend of MaryS? Anyway, I'm hoping this case will fall apart and the trial will never happen, because I think there is something very suspicious about the way things went down in Peru.

Marie 27 May 2011 - 7:31pm / USA

Yep. Good 'ol MaryS.!
